SURGEON SUSPENDED OVER LASER VAGINAL REJUVENATION TREATMENT

 

A former NHS Gynaecologist, Professor Phanuel Dartey has been suspended from practice by the GMC pending investigations into his treatment of 5 patients suffering from a range of gynaecological issue.
 
 The allegations against Professor Dartey include the following:
 
- inappropriately offering/proceeding with treatment.
- causing visible scarring.
- failing to obtain informed consent.
- failing to hold valid medical insurance.
- perforating the uterus during the course of a procedure without recognising that he had done so.
- failing to perform surgery to a reasonably competent standard.
- failing to keep adequate notes.
 
Professor Dartey had promoted himself as a pioneer in laser vaginal cosmetic surgery, however, these allegations present serious concerns in relation to his past practices. 
 
Professor Dartey has been in practice for over 40 years, having previously qualified in Russia before working for the NHS.  He was one of the only surgeons in the UK to use the Laser Vaginal Rejuvenation (LVR) technique which had been pioneered in the US.
 
One of the benefits of the LVR technique was that incisions in the vaginal wall which would normally be made with a scalpel for example during an anterior or posterior repair could be performed with a laser which, in theory, resulted in less bleeding and quicker healing.  However, a wider use of the laser was to cosmetically alter the appearance of the vagina or labia.  Such practices  have come under criticism in the US by the American College of Obstetricians and Gynecologists (ACOG) which published the paper  Vaginal “Rejuvenation” and Cosmetic Vaginal Procedures (2007) which expressed their opposition to the commercial misrepresentations of labiaplasty, and associated vaginoplastic procedures, as medically “accepted and routine surgical practices”.
 
Christian Beadell, an Associate Solicitor at Goodmans Law commented as follows:
 
“Whilst Professor Dartey maintains that he has only had one complaint and is astonished by his suspension, the allegations listed by the GMC, which relate to 5 different patients, give rise to fundamental issues concerning his practices.  Of particular concern is the failure to obtain adequate consent for procedures in some cases and failing to provide surgery to a reasonable standard.
 
It is only right that Professor Dartey be given an opportunity to respond to the allegations, however, if further complainants materialise which suggest that these were not isolated incidents, then this will raise significant concerns with regards to his competency. 
 
Whilst innovative techniques should be encouraged, it is vital that patients are not placed at any higher risk of injury, but that if they wish to accept such risks, that they are adequately advised beforehand to enable them reach a fully informed decision.
 
We have had a great deal of experience in the field of gynaecological claims, in light of the action we are pursuing against a local urogynaecologist where we represent nearly 400 claimants.”
