PROFESSIONAL NEGLIGENCE
We are more and more often instructed by clients who have had a personal injury or medical negligence claim but have instructed a non specialist firm. They come to us because either they feel that their case has been under settled, their solicitor has missed an important time limit, that they have been badly advised or that cases requiring court approval have been settled without obtaining approval.
If the case hasn’t settled, we can request the papers and review the case with fresh eyes. However, if a case has settled then clients often think there is nothing more then they can do. In fact, there is something you can do if you find yourself in this situation. Whilst you cannot claim against the defendant who caused your original injury you may be able to bring a separate claim for negligence against the solicitor who acted for you and can claim from them all the compensation you should have received as a result of your injury.
These types of cases are called professional negligence cases and can be undertaken on a No Win No Fee basis.
All law firms have to carry compulsory insurance to pay out such claims so even if the firm has ceased to exist we will still be able to bring a claim on your behalf.
